SPECIAL REGISTRATION OF CERTAIN NONIMMIGRANTS

The information contained herein is for purposes of illustration only; it is not legal advice.

The requirements apply only to nonimmigrant aliens, i.e., not to Lawful Permanent Residents and U.S. Citizens.  There are ongoing re-registration and exit registration requirements after the initial registration mentioned below.  Specifically, (1) 30 to 40 days after initial registration, (2) every twelve months after initial registration, (3) upon certain events such as changes in address, school, or employment, and (4) upon departure from the U.S.  Initial registration includes being fingerprinted and photographed.  The purpose of this table is to indicate who is, according to both published notices and known DOJ internal guidelines, per se subject to the requirements, and how those people must initially register.  Nonimmigrants other than those identified here may be required to register if they fit certain “pre-existing criteria.”

Note that the age and sex limitations are different for nationals of different countries, and different for those from the same country depending on whether they were already here or are being registered upon arrival.  For example, all Syrian nonimmigrants must register upon entry, but as to those already in the U.S. prior to September 11, 2002, only Syrian nonimmigrant males born before November 15, 1986 need to register.  Note also that for those who must register upon arrival, immigration officers will register anyone who they have reason to believe is from a designated country.  Other discretionary factors obtain as well.

Also not subject to the requirements:

1.  Nonimmigrants in valid diplomatic (“A” or “G”) status.

2.  Most asylees and pending asylum applicants, depending on the date of grant or application.

Afghanistan

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before January 10, 2003.

No one admitted after September 30, 2002 is per se required to register, and there is no requirement yet to register upon entry to the U.S.  Anyone, however, can be required to register upon entry based on instructions distributed to inspecting officers.

Algeria

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before January 10, 2003.

No one admitted after September 30, 2002 is per se required to register, and there is no requirement yet to register upon entry to the U.S.  Anyone, however, can be required to register upon entry based on instructions distributed to inspecting officers.

Bahrain

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before January 10, 2003.

No one admitted after September 30, 2002 is per se required to register, and there is no requirement yet to register upon entry to the U.S.  Anyone, however, can be required to register upon entry based on instructions distributed to inspecting officers.

Eritrea

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before January 10, 2003.

No one admitted after September 30, 2002 is per se required to register, and there is no requirement yet to register upon entry to the U.S.  Anyone, however, can be required to register upon entry based on instructions distributed to inspecting officers.

Iran

Nonimmigrant males, born on or before November 15, 1986, who were admitted to the United States on or before September 10, 2002, and who will remain in the U.S. at least December 16, 2002.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before December 16, 2002.

Note that this group, i.e., those entering before 9/11/2002, includes only males, about 16 years of age or older.

All nonimmigrant aliens (no sex or age specified), entering the United States on or after September 11, 2002.

Registration upon arrival: Must register with an immigration officer at port of entry, upon arrival.

Note that this group, i.e., those entering on or after 9/11/2002, includes both men and women and has no age limit.

Iraq

Nonimmigrant males, born on or before November 15, 1986, who were admitted to the United States on or before September 10, 2002, and who will remain in the U.S. at least December 16, 2002.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before December 16, 2002.

Note that this group, i.e., those entering before 9/11/2002, includes only males, about 16 years of age or older.

Lebanon

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before January 10, 2003.

No one admitted after September 30, 2002 is per se required to register, and there is no requirement yet to register upon entry to the U.S.  Anyone, however, can be required to register upon entry based on instructions distributed to inspecting officers.

Libya

Nonimmigrant males, born on or before November 15, 1986, who were admitted to the United States on or before September 10, 2002, and who will remain in the U.S. at least December 16, 2002.

North Korea

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.

Oman

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.

Pakistan

Nonimmigrant males, born on or before January 13, 1987, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. after February 21, 2003.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. between January 13 and February 21, 2003, inclusive.

Note that this group, i.e., those entering on or after 10/1/2002, includes only males who are between ages 16 and 45 upon entry.  A 46-year old entering on or after 10/1/2002 who is not registered upon entry, will not have to  do call-in registration under the extant notices.

Nonimmigrant males, 16 to 45 years of age, entering the United States on or after October 1, 2002.

Registration upon arrival: Must register with an immigration officer at port of entry, upon arrival.

Note that this group, i.e., those entering on or after 10/1/2002, includes only males who are between ages 16 and 45 upon entry.

Qatar

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before January 10, 2003.

No one admitted after September 30, 2002 is per se required to register, and there is no requirement yet to register upon entry to the U.S.  Anyone, however, can be required to register upon entry based on instructions distributed to inspecting officers.

Saudi Arabia

Nonimmigrant males, born on or before January 13, 1987, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. after February 21, 2003.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. between January 13 and February 21, 2003, inclusive.

Note that this group, i.e., those entering before 10/1/2002, includes only males, about 16 years of age or older.

Nonimmigrant males, 16 to 45 years of age, entering the United States on or after October 1, 2002.

Registration upon arrival: Must register with an immigration officer at port of entry, upon arrival.

Note that this group, i.e., those entering on or after 10/1/2002, includes only males who are between ages 16 and 45 upon entry.  A 46-year old entering on or after 10/1/2002 who is not registered upon entry, will not have to  do call-in registration under the extant notices.

Somalia

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before January 10, 2003.

No one admitted after September 30, 2002 is per se required to register, and there is no requirement yet to register upon entry to the U.S.  Anyone, however, can be required to register upon entry based on instructions distributed to inspecting officers.

The Sudan

Nonimmigrant males, born on or before November 15, 1986, who were admitted to the United States on or before September 10, 2002, and who will remain in the U.S. at least December 16, 2002.

“Call-in” registration: Must appear before an immigration officer at one of the specified CIS offices in the U.S. on or before December 16, 2002.

Note that this group, i.e., those entering before 9/11/2002, includes only males, about 16 years of age or older.

United Arab Emirates

Nonimmigrant males, born on or before December 2, 1986, who were admitted to the United States on or before September 30, 2002, and will remain in the U.S. until at least January 10, 2003.
